Visa stamp vs I-94: the critical distinction
The visa stamp lets you enter. The I-94 lets you stay. They have different dates.
You can be lawfully present in the U.S. with an expired visa stamp, as long as your I-94 remains valid.
How to check your real status
Go to i94.cbp.dhs.gov and pull your most recent I-94. The 'Admit Until Date' is what controls your legal stay.
F-1 and J-1 students see 'D/S' instead of a date — meaning they can stay as long as they maintain status on a valid I-20 or DS-2019.
If your I-94 has expired
Staying past your I-94 = accruing unlawful presence.
180 days of unlawful presence = 3-year bar on future re-entry. 365 days = 10-year bar.
Both bars apply the moment you leave the U.S. — you cannot return without a waiver.
Pending extension applications freeze the clock
Filing an I-539 (change or extension of status) before your I-94 expires generally stops unlawful presence from accruing while USCIS decides.
H-1B, L-1, and O-1 workers get an automatic 240-day work extension if their employer files I-129 before I-94 expiration.
Overstaying voids your visa stamp
Under INA §222(g), overstaying automatically voids any remaining validity on your visa stamp — meaning you must apply for a new visa from your home country consulate.
You cannot apply from a third country in most cases.
